UNAIR Holds Focus Group Discussion on Criminal Violations in Kanjuruhan Tragedy

Airlangga University Surabaya held a Focus Group Discussion (FGD) to examine the case and legal responsibility for the Kanjuruhan tragedy which defeated 134 people. During the discussion, experts on criminal law and human rights said that the Kanjuruhan tragedy did not meet the elements of premeditated murder or human rights violations.

The discussion, which was held by Airlangga University, presented 10 experts in the field of criminal law, chemists, human rights experts, psychologists and forensic experts. The experts and participants focused on dissecting the articles and criminal offenses with reference to the report of the team officially formed by the government and the evidence found in the Kanjuruhan tragedy.

A criminal law expert at the University of Airlangga stated that the Kanjuruhan tragedy could not be said to be premeditated murder and would rather be subject to Article 359 of the Criminal Code where the party responsible was the commander who ordered the tear gas killing. While members who do, cannot be punished for carrying out position orders.
